Terms of Service

1. Agreement to Terms


By subscribing to a Maxwell Sim Racing membership (“Service”), you agree to these Terms of Service (“Terms”).
If you do not agree, you may not access or use our services.



2. Membership and Access


  • Membership grants access to our racing simulators during business hours (12 PM – 10 PM).
  • Access is personal and non-transferable. We may request identification to verify membership.
  • We reserve the right to refuse or revoke service for misuse, unsafe behavior, or violation of these Terms.




3. Billing and Payments


Maxwell Sim Racing memberships are billed securely through Stripe on a recurring basis according to the selected plan.


Monthly Plans (billed every 1 month)


  • Starter — $149 per month
  • PRO — $199 per month
  • ELITE — $299 per month



3-Month Plans (billed every 3 months, prepaid)


  • Starter — $129/month, billed every 3 months
  • PRO — $149/month, billed every 3 months
  • ELITE — $249/month, billed every 3 months



6-Month Plans (billed every 6 months, prepaid)


  • Starter — $99/month, billed every 6 months
  • PRO — $129/month, billed every 6 months
  • ELITE — $229/month, billed every 6 months


Multi-month plans are prepaid for the full 3- or 6-month period at the time of billing.

Recurring Billing


  • All plans renew automatically at the end of each billing period (1, 3, or 6 months), unless canceled in advance.
  • By subscribing, you authorize Maxwell Sim Racing to charge your selected payment method for recurring membership fees and any applicable taxes, according to your chosen plan.




4. Price Changes


  • Membership prices may change with prior notice.
  • Continued use of the Service after a price change constitutes acceptance of the new pricing.




5. Cancellations


  • You may cancel your membership at any time through the secure Customer Portal link provided in your confirmation email.
  • Cancellation becomes effective at the end of your current paid billing period (1, 3, or 6 months).
  • You retain access to the Service until that date.
  • No refunds are provided for unused time within a billing period.
  • Prepaid 3-month and 6-month plans are non-refundable once charged.


Stripe will send you a cancellation confirmation email.



6. Refunds


All membership payments are final and non-refundable, except in the following cases:

  • duplicate charges
  • verified technical or processing errors


Refund requests must be submitted within 7 days of the charge date.



7. Service Availability and Modifications


  • We may modify, suspend, or discontinue the Service at any time with reasonable notice.
  • We are not responsible for interruptions caused by events beyond our control, including maintenance, internet outages, or force majeure events.




8. Assumption of Risk


Participation in sim racing sessions is at your own risk.
Maxwell Sim Racing is not responsible for any injuries, discomfort, or damages arising from the use of the Service or equipment.



9. Limitation of Liability


Maxwell Sim Racing shall not be liable for any indirect, incidental, special, or consequential damages.
Our total liability for any claim shall not exceed the total membership fees you paid during the three (3) months preceding the event giving rise to the claim.



10. Governing Law


These Terms are governed by the laws of the State of California, USA.
Any disputes will be resolved exclusively in the state or federal courts located in Orange County, California.



11. SMS Communications


By providing your phone number, you agree to receive SMS text messages from Maxwell Sim Racing, including:

  • service and booking notifications
  • billing reminders
  • membership updates
  • promotional messages


You can opt out at any time by replying STOP, UNSUBSCRIBE, or CANCEL to any SMS message.
Message and data rates may apply.



12. Email Communications


By providing your email address, you agree to receive email communications from Maxwell Sim Racing, including:

  • receipts and billing information
  • service updates and membership notices
  • promotional offers and news


You can unsubscribe from marketing emails at any time by clicking the Unsubscribe link in the footer of any email.
You may still receive essential service emails (for example, billing receipts and critical account notifications).
